The Vienna Higher Regional Court did not follow the reasoning of the Korneuburg Regional court, mainly by pointing out that Mr. Griess had madeuse of his right to freedom of expression. As there is as yet no Supreme Court ruling in such a case, an appeal to the Supreme court was expressly authorized.
